Class Sync Publisher Terms

1. Acceptance of Terms
The services provided by Class Sync Corp. ("Company") are offered to you, the "Publisher," subject to your acceptance of these Terms of Service, without modification. By accessing and using the services, you agree to be bound by these Terms. If you are entering into these Terms on behalf of an entity (e.g., your employer), you warrant that you have the legal authority to bind the entity. In such cases, references to “you,” “your,” or “Publisher” refer to the entity.
2. Definitions

Account: The primary method for accessing and using the Services, subject to payment as outlined in the selected Plan.

Administrator: An authorized user with full control over the Publisher Account.

Affiliates: Entities controlling, controlled by, or under common control with a party.

Apps: Software applications accessed through mobile, web, or smart TV platforms.

Content Delivery Network (CDN): Networks that facilitate efficient delivery of digital content.

Publisher Content: All data, videos, and materials uploaded by the Publisher to the Platform.

Sensitive Information: Includes but is not limited to financial information, government-issued IDs, and biometric data, as further defined under applicable privacy laws.

Subscriber: An end-user who accesses and/or purchases content from the Publisher via the Platform.

Sub-Processor: Any third party engaged by the Company to process data in providing the Services.

Services: The platform, web applications, and associated offerings provided by Class Sync Corp.
3. Modifications to the Terms
The Company reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting. Continued use of the Services constitutes acceptance of such modifications.
4. Services
4.1 License to Use the Services: Upon payment of applicable fees, the Publisher is granted a non-exclusive, non-transferable, and non-sublicensable right to:

Upload and manage Publisher Content for distribution to Subscribers.

Customize the user interface for Subscriber interaction with Publisher Content.
4.2 Modifications to Services: The Company may modify or discontinue any aspect of the Services without prior notice. This includes adjustments to fees, features, or the discontinuation of certain Services.
5. Responsibilities of the Publisher
5.1 Credentials: Publishers are responsible for maintaining the confidentiality of login credentials and ensuring that all activities conducted under their account comply with these Terms. The Company reserves the right to suspend or terminate access to accounts if it detects unauthorized or illegal use.
5.2 Compliance with Laws: Publishers agree to comply with all applicable laws, including data protection and intellectual property laws, when using the Services. Any content uploaded by the Publisher must not infringe on the rights of third parties.
5.3 Content Ownership and License: The Publisher retains ownership of Publisher Content but grants the Company a worldwide, non-exclusive license to store, distribute, and process the Publisher Content as part of providing the Services.
6. Fees and Payment
6.1 Fees: Publisher agrees to pay fees as outlined in the selected Plan. The Company reserves the right to adjust fees with notice, effective at the next renewal date. 6.2 Renewals: Plans will automatically renew unless terminated in accordance with Section 7. 6.3 Refund Policy: Refunds are only provided as required by law or as otherwise stated in the Plan terms.
7. Termination
7.1 Termination by Publisher: The Publisher may terminate the Agreement at any time by discontinuing use of the Services.
7.2 Termination by Company: The Company may terminate the Publisher’s access to the Services for non-payment, breach of these Terms, or illegal use of the Services. Termination is effective immediately upon notification.
8. Limitation of Liability
In no event shall Class Sync Corp. be liable for indirect, incidental, special, or consequential damages, including but not limited to loss of profits, business interruption, or loss of data, arising out of or in connection with the use of the Services.
9. Governing Law
These Terms are governed by and construed in accordance with the laws of the state in which Class Sync Corp. is headquartered, without regard to its conflict of laws provisions. Any legal disputes will be resolved in the courts of that state.
10. Data Protection and Privacy
The Company agrees to process Publisher Content in compliance with applicable data protection laws and its Privacy Policy, available at Privacy Policy.
